DJ TechTool published an article written by the owner of MixCloud
. I expressed my opinion on the subject in a comment. But after I finished that comment I thought why not start the discussion on my favorite soap box: Reddit.
Let me start by stating I'm all for everyone getting his/her fair share of the "live performance" pie. Artists, performers and composers should be paid if their tracks are used in whatever context. From that perspective I fully support MixCloud. How could anyone disagree with that?
But here is reality.
Historically MixCloud was the place where you upload your mixtapes that Soundcloud would refuse to publish due to copyright infringements. The MixCloud platform is mainly populated and consumed by DJs. I, being a DJ, enjoy listening to other DJ's. But if you're a streaming DJ you don't want DJs as your main audience, you want the audience that usually would go to your live performances. And you hope for the accidental viewer who stumbles on your stream and instantly becomes a fan of what you do. But that audience is far and in between on MixCloud. They might know about SoundCloud if they are really into music but being on MixCloud means they have an above average interest in the DJ scene.
If we define 'target audience' for the majority of streaming DJs roughly as the millennia's +/- 10 years (I'm 53, so I'm allowed to say this :P), then that audience is found on other (social) platforms:
- YouTube, but no way you can do a streaming live set there using any commercial tracks without being taken down
- Instagram: see YouTube
- Twitch, the platform where the target audience traditionally gathers to watch others play games
Facebook is missing, that's the millennia's parents platform ;)
Twitch is owned by Amazon. A company only rivaled by another IT mastodon: Apple. Amazon has its own "Spotify" named Amazon Music, with contracts in place with most if not all record labels. Amazon itself is by far the biggest retailer of physical CD's (if they are still being sold at all). Say about Amazon's CEO Bezos whatever you want, the man had a vision and executed on it successfully.
The parallel with Apple begins here. Steve Jobs strong armed the music industry in selling music digitally through the iTunes Music Store in 2003. In those days pirate services like Napster ate the industrie's lunch left & right. The music industry acknowledged they needed what Apple had to offer, so they were dragged in kicking and screaming.
Fast forward to 2020, Twitch is where the target audience for most DJ's is at. No need to ask them to set up an account, they most likely have one already.
The music industry can't afford to abandon Amazon, but they don't like what the Twitch branch is doing. So what does Twitch do? They send out scary e-mails to the DJs on their platform, with terms like 3 strikes out, DMCA and take down in almost every paragraph. "Look music industry, we listen to you."
At the same time Twitch offers various DJs to become partner, a special status in the Twitch ecosystem that comes with various perks. This partner status is offered with Twitch being fully aware of what is happening in he DJ's channel: live performance of copyright protected music.
Where YouTube and Instagram, take down live streams the moment the algorithm detects an IP infringement, I have to see the first DJ live stream to be taken down from Twitch. And don't think Amazon hasn't have the technology to do this. We are talking about the company that hosts a 3th of the internet through Amazon Web Services.
The Twitch platform has a few extra aces up its sleeve from its gaming origins:
- an excellent audience interaction system
- a monetization model where the performer can be rewarded in the platform's currency "Bits", which can be exchanged for real life US$. Without the spectator having to set up yet another dedicated wallet.
- the possibility to "raid" a stream, enabling a virtual festival hosted by different artists
- tight integration with re-streaming services, for those DJs who don't bet on a single platform but who want to distribute their stream as broad as possible. Including things like sharing what is going on in the chat across all re-streamed platforms and reliable viewer counts.
So far I've been talking about the live streaming experience of Twitch. On demand playback (aka archiving or storing a played live set) is an entirely different story. I can see Twitch upholding any IP infringement there. And even take channels down that repeatedly violated the rules. It is not in Twitch's interest to endorse on demand playback, the monetization possibilities are fairly limited missing the "Bits" reward system which they earn a small percentage from each time Bits change hands.
So this might be a niche that services like MixCloud could fulfill.
Personally, I don't see a need for "watching back live streams". If I want to see a DJ set on my favorite festival, and that set is programmed in the middle of the night, then I have to set my alarm. Same with streamed live sets. Part of the fun, at least for me, is active participation in the chat and rewarding a performance I enjoy. Experiencing the moment with like minded people.
I can hear the "but that monetization is not fair for the label, composer, performing artist etc" and yes that is not fair. I come from a financial market background, where we have a saying: you have to play the market that is in front of you, not the market you want.
Same for streaming DJs: Twitch is the place where it's happening. How unfair this might be for other stakeholders.
I've heard of DJs making a real income from their Twitch performances, not only replacing but even surpassing the income they had from "regular gigs". Without traveling all over the globe, calling hotel rooms home, hours waiting on airports and all other less popular aspects of DJ life.
Covid 19 will change the face of the industry entirely. I can imagine that events such as Tomorrow Land, generate a considerable revenue from their excellent virtual events. Without all the uncontrollable elements from a real event such as weather, violent behavior by some spectators and pandemics.
Of course real world events will rise up again once the Covid 19 vaccine has proven to be effective and is administered in large enough doses to ensure hurt immunity. But those real world events will have serious competition from the streaming experience.
Twitch has set the standards a streaming platform for DJs must meet. Exactly like Napster did for online availability of Music. If Twitch can maintain its dominant, and arguably illegal, position remains to be seen, my money is on "yes" given the power behind the platform. But that doesn't leave room for others platforms to rival it.
